Property transfer tax is payable each time a property is transferred to another person (and there is money involved), and it is 3% of the purchase price or appraised value estimated by expert opinion- whichever is greater. Property transfer tax, according to the law, is paid by the seller. The seller is obliged to pay within three months of the transfer of ownership at the Land Registry Office. If the seller does not do so, then the duty to pay this tax is passed on to the guarantor, which is in this instance, the buyer. Therefore, it is advisable to secure the property transfer tax right after the closure of the contract through escrow via a notary, lawyer or realtor. Our office offers free of charge escrow of property transfer tax that we will pay on the seller’s behalf so the seller can be confident that the property transfer tax has really been paid.
